Terms of Service

Last updated: October 14, 2026

A note on scale: these Terms reflect Kinstodian's size today. We've committed to giving them a full review — not just for accuracy, but for whether they're still the right approach — once our combined base of users and partners passes 1,000, or sooner if anything material changes.

These Terms of Service ("Terms") govern your use of Kinstodian, a browser-based estate and care planning tool, and the kinstodian.com website (together, the "Service"), provided by Kinstodian LLC ("Kinstodian," "we," "us"). By using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. What the Service is

Kinstodian helps you organize an estate or care plan — accounts, contacts, documents, and instructions — entirely on your own device. There is no account or login: your plan is created and stored locally, encrypted with a key generated on your device. Full detail on exactly what this means for your data is in our Privacy Policy and Trust & Privacy page; those pages are incorporated into these Terms by reference for anything about data handling that this document doesn't repeat.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase a plan. Kinstodian is often used by a family member on behalf of an aging or ill relative — that's expected and fine — but the person who purchases a plan and agrees to these Terms must meet this age requirement themselves.

3. No account, and what that means for your responsibility

Because Kinstodian doesn't use accounts or passwords tied to us, there is nothing for us to reset or recover on your behalf if you lose access to your device. You are solely responsible for keeping your device and your recovery code(s) safe. Section 8 explains this in full; read it before you need it, not after.

4. Plans and pricing

As of this writing, Kinstodian offers four plans: Monthly (renews monthly until cancelled), Annual (renews annually until cancelled), 3-Year (one payment, does not renew), and 5-Year (one payment, does not renew). Kinstodian also offers a 90-day free trial with no card required to start. The price of each plan is shown on our pricing page at the time you buy. The price shown when you buy is the price you pay.

We may change prices or plans going forward; a change will not apply retroactively to a term you've already paid for in full (your 3-Year or 5-Year plan won't be charged again before its term is up), and we will give notice before a price change takes effect on your next renewal for a monthly or annual plan.

5. Payment processing

All payments are handled by Stripe, a third-party payment processor, at Stripe's own checkout page. We do not receive, process, or store your card number or other payment credentials. See our Privacy Policy, Section 5, for exactly what we do receive from Stripe (Stripe gives us your email address and the plan only so we can email you your license. We don't keep the address in our own records unless you ask us to send a lost license again.)

6. Cancellation, and what happens to your plan afterward

You may cancel a recurring (Monthly or Annual) plan at any time; cancellation stops future renewals and does not entitle you to a prorated refund for the current term unless required by law in your jurisdiction. Because your plan data lives on your device, not on our servers, cancelling or letting a plan lapse does not delete or lock the plan you've already built. You keep everything you've entered, on your device, and it remains readable and exportable whether or not you continue paying. What a paid plan provides is the ongoing ability to add to and change it.

7. Refunds

If you purchase a 3-Year or 5-Year plan, you may request a full refund within 14 days of your purchase date, no reason required — email support@kinstodian.com from the email address you used to pay. Tell us which plan you bought and the date you bought it. If you have your Stripe receipt number, include it. These one-time plans can't be "cancelled" the way a subscription can, so this window is the mechanism for changing your mind. After 14 days, 3-Year and 5-Year purchases are final.

Monthly and Annual plans are cancel-anytime (Section 6) rather than refund-eligible: cancelling stops future renewals, but a term you've already paid for is not refunded, whether monthly or annual, except where required by law in your jurisdiction.

8. Data loss, and the limits of what we can do about it

This is the most important section in these Terms to read, because it follows directly from how Kinstodian is built and is not a limitation we can lift by trying harder. We do not hold a copy of your plan, and we do not hold a copy of your encryption key. If you lose your device, lose your recovery code, or otherwise lose access to your plan, we cannot restore it, recover it, or provide you a backup, under any circumstance — including at your request, and including through legal process, since we have nothing responsive to produce. This is not a promise we're declining to make; it is a direct consequence of a design intended to keep everyone, including us, unable to read your plan. See our Trust & Privacy page for the full explanation of why the product works this way. You are responsible for your own backups (Kinstodian provides in-app backup tools for this reason — use them) and for keeping your recovery code somewhere safe and separate from your device.

9. Acceptable use

You agree not to use the Service to store or transmit unlawful content, to attempt to interfere with or disrupt the Service or its infrastructure, to attempt to circumvent the Service's security or encryption, or to use the Service on behalf of someone without their knowledge and authorization where that authorization is legally required (for example, managing someone else's affairs under a power of attorney you don't actually hold).

10. Intellectual property

The Service, including its design, text, and code, is owned by Kinstodian and protected by applicable intellectual property laws. These Terms don't grant you any rights to Kinstodian's intellectual property beyond what's needed to use the Service as intended. You retain all rights to the content of your own plan — it's your data, stored on your own device; we don't claim any ownership or license over it, and structurally can't, since we never receive it.

Kinstodian is a technology provider, not a financial, medical, or legal advisor.

The Services — including the estate and care-plan checklist itself, the state-specific legal-content orientation (plain-language, in-house-researched notes on each state's probate, small-estate, and estate/inheritance-tax procedures), and the built-in financial estimators (the property carrying-cost projection and the transition-fund calculator, both of which turn figures you enter into a monthly or total-cost estimate) — are designed to help you organize information and see likely outcomes based on what you enter, so that you and the people you rely on (an attorney, a financial advisor, a hospice or care team) have an organized starting point, not a finished answer.

Acknowledgment of Non-Responsibility: You acknowledge that Kinstodian is not responsible for any legal advice implied by the software. You release Kinstodian from liability related to purchasing any financial or legal product based on our platform's models.

12. Disclaimers

13. Limitation of Liability

Exclusion of Damages: To the maximum extent permitted by applicable law, in no event shall Kinstodian, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. This includes, without limitation, damages for loss of profits, revenue, data, goodwill, service interruption, computer failure, or any harm resulting from your reliance on the information you entered into your plan, the state-specific legal-content orientation, or any cost or readiness estimate the Service calculates, even if Kinstodian has been advised of the possibility of such damages.

Monetary Liability Cap: To the maximum extent permitted by law, Kinstodian's total cumulative liability arising out of or related to these Terms or your use of the Services shall not exceed the greater of:

Essential Purpose: You acknowledge that these limitations reflect a reasonable allocation of risk and are a fundamental basis of the bargain between you and Kinstodian.

14. Indemnification

You agree to defend, indemnify, and hold harmless Kinstodian, its affiliates, licensors, and service providers, as well as their respective officers, directors, employees, contractors, agents, and successors, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Kinstodian reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate fully with Kinstodian in asserting any available defenses.

15. Termination

We may suspend or terminate your access to the Service's hosted features (support, organization referral features) if you violate these Terms. Because your plan data lives on your device, not ours, termination of hosted-feature access does not affect your ability to use or access the plan data you've already entered on your own device.

16. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll update the "Last updated" date above and, where practical, notify you. Continued use of the Service after a change takes effect means you accept the updated Terms.

17. Governing Law and Dispute Resolution

Governing Law: These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your relationship with Kinstodian shall be governed by and construed in accordance with the laws of the State of Kansas, without giving effect to any principles of conflicts of law that would require the application of the laws of another jurisdiction.

Jurisdiction and Venue: You agree that any legal action, suit, or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state courts located in Johnson County, Kansas, or the United States District Court for the District of Kansas. You hereby irrevocably consent and submit to the personal jurisdiction and venue of such courts.

Waiver of Jury Trial: TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY HEREBY IRREVOCABLY WAIVES ITS RIGHT TO A JURY TRIAL IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.

Class Action Waiver: YOU AND KINSTODIAN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
